Terms of service

We are in the process of elaborating our Terms of Service (hereafter "ToS") and our Privacy Policy. You'll find our draft Terms of Service further down on this page.

In the mean time, these are our house rules:

  1. You own your projects. Therefore, you can decide what kind of license (standard copyright, creative commons) applies to your work.
  2. You can decide whether your projects are viewable publicly or in private only.
  3. You can decide whether or not your texts are viewable in Bite-Size Edits.
  4. You grant us the right to display your text on our website, subject to the conditions available in our platform.
  5. Your text is yours, you are free to remove it at anytime.
  6. You can delete your account, though we would have to keep some aggregate data about stuff you've done.
  7. If you contribute to Bite-Size Edits, you grant rights of your contributions to the project owner.
  8. You may not upload text with copyright owned by another party, without express written agreement.
  9. DMCA: We will take down texts upon DMCA notice, and investigate further.
  10. Don't do anything illegal here. If you do, you might be banned.
  11. Don't harass anyone here. If you do, you might be banned.
  12. Play nice! Be respectful of the community and its collective decisions.

Terms of Service (draft)

By using the BOOKOVEN and related web site and services, you agree to be bound by the following Terms of Service ("Terms" and "Service").

Book Oven Inc (hereafter BOOKOVEN) may update, change or alter the Terms from time to time, and will post to notify members. New features added or subtracted to the current Service shall be subject to these Terms. Continued use of the Service after any such changes shall constitute your consent to such changes. BOOKOVEN reserves the right at any time to time to modify or discontinue, temporarily or permanently, the Service (or parts thereof) with or without notice.

In the document below, "The Site" refers to bookoven.com, Bite-Size Edits, and related web sites.

Account Terms

1. You must be 13 years or older to use this Service.

2. You are solely responsible for maintaining the security of your account, including maintaining the secrecy of your password. You agree to indemnify BOOKOVEN against any loss or damage from your failure to comply with security obligations under these Terms.

3. BOOKOVEN provides a service to allow you to collaborate on making books. BOOKOVEN makes no claim about the accuracy, legality, content, business practices and privacy policies of external sites which are linked to from BOOKOVEN, or for the content uploaded by Site members. BOOKOVEN is NOT RESPONSIBLE FOR MEMBER TEXTS, or third-party sites, including content, linked from BOOKOVEN user accounts.

4. BOOKOVEN may not be used by any user for any illegal purposes whatsoever, or to violate any laws in the user's jurisdiction (including but not limited to copyright laws).

General Conditions

1. Use of the Service

Use of the Service is at your SOLE RISK, and is provided on an as is and as available basis. BOOKOVEN makes no guarantees about interruptions in service, speed of service, security of information, or accuracy of the service or the information provided therein. BOOKOVEN is in no way responsible for any loss (financial or otherwise) resulting from the use of the service.

2. Removal of Accounts

BOOKOVEN reserves the right to remove Accounts of users that we deem unlawful, objectionable or violate any party's intellectual property or these Terms.

3. Enforcement

The failure of BOOKOVEN to exercise or enforce any right or provision of these Terms shall not constitute, or be considered a waiver of such right or provision. These Terms constitute the entire agreement between you and BOOKOVEN and govern your use of the Service, superseding any prior agreements between you and BOOKOVEN (including, but not limited to, any prior versions of the Terms).

4. Third Party Content

BOOKOVEN is explicitly not responsible for third-party use of public BOOKOVEN content, including your publicly available texts, and is under no obligation to restrict this access (except for text which you decide to restrict). BOOKOVEN provides you with the ability to retrieve and remove your posted content and your personal information from the Site and the Services. This ability does not extend to copies that others may have made or to copies that BOOKOVEN may have made for backup purposes.

5. Copyright

  1. You own the copyright on texts you submit to BOOKOVEN and you may assign any license, including Creative Commons licenses.
  2. You grant BOOKOVEN the right to display your texts, as defined in your user and project settings.
  3. It is a violation of the terms of service to upload content for which you do not have permission from copyright holder.
  4. DMCA notices will result in takedown of suspect material, subject to investigation by BOOKOVEN.
  5. Your Bite-size edits belong to the project owner.

6. Feeds

BOOKOVEN provides access to portions of its Site and Services via RSS feeds; for the purposes of these Terms, such access constitutes use of the Site and Services. BOOKOVEN asks that you use these features respectfully.

7. No Warranty and Limitation of Liability

You understand and agree that you use the Site and Services at your own discretion and risk and that you will be solely responsible for any damages that arise from such use. BOOKOVEN SHALL, UNDER NO CIRCUMSTANCES, BE HELD LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES OF ANY KIND WHATSOEVER, OR ANY OTHER DAMAGES WHATSOEVER (HOWEVER THEY ARISE, INCLUDING BUT NOT LIMITED TO, BY NEGLIGENCE), INCLUDING WITHOUT ANY LIMITATION, DAMAGES RELATED TO USE, MISUSE, RELIANCE ON, INABILITY TO USE AND INTERRUPTION, SUSPENSION, OR TERMINATION OF THE SITE OR SERVICES, DAMAGES INCURRED THROUGH ANY LINKS OR FEEDS PROVIDED ON THE SITE AND THE NONPERFORMANCE THEREOF AND DAMAGES RESULTING FROM LOSS OF USE, SALES, DATA, GOODWILL OR PROFITS, WHETHER OR NOT BOOKOVEN HAS BEEN ADVISED OF SUCH POSSIBILITY. YOUR ONLY RIGHT WITH RESPECT TO ANY DISSATISFACTION WITH THIS SITE OR SERVICES OR WITH BOOKOVEN SHALL BE TO TERMINATE USE OF THIS SITE AND SERVICES. Some states do not allow the exclusion of liability for incidental or consequential damages, so the above exclusions may not apply to you.
